Common terms in a Modern Slavery Statement
Modern Slavery Statements are used to provide information about the steps your business is taking to ensure that the business and its supply chains are free from modern slavery and human trafficking. To facilitate this, this MSS covers:
Introduction
This section sets out that the Modern Slavery Statement is being carried out in response to the Modern Slavery Act 2015 and states the business’ commitment to preventing modern slavery and human trafficking from occurring in its business and supply chains. It also identifies the business in question and sets out which financial year the MSS relates to.
Organisational structure
This section sets out the structure of the business and whether it operates outside of the UK. It also explains what business sector the business operates in and provides details of the business’ supply chains.
Policies
If relevant, this section sets out the internal policies the business has in place to ensure that the business is being conducted in an ethical and transparent manner.
Due diligence
This section sets out the due diligence procedures that the business has in place to monitor and reduce the risk of slavery and human trafficking occurring in its supply chains.
Risk and compliance
This section sets out how the business evaluates the risk of slavery and human trafficking occurring in its supply chains. It also details the specific risk level of the business.
Effectiveness
This section deals with the effectiveness of the measures implemented by the business to prevent slavery and human trafficking from occurring.
If relevant, this section explains specific Key Performance Indicators (KPIs) that the business implements. These KPIs are used to measure its effectiveness and to ensure that slavery and human trafficking are not taking place in the business itself or its supply chains.
If not relevant, the section will highlight that the business cannot say with certainty how effective the preventative steps are. It does, however, highlight that the business will investigate how best to monitor the effectiveness of all actions taken in the next financial year.

Legal tips for making a Modern Slavery Statement
Understand when a Modern Slavery Statement must be carried out
Businesses of a certain type and size must publish an annual MSS. Any businesses that do not meet the criteria for a mandatory MSS may wish to publish a voluntary MSS, outlining the steps they take to tackle and prevent modern slavery and human trafficking.

Remember to get your Modern Slavery Statement approved
Before publishing an MSS, it needs to be approved by the relevant parties. Who the relevant parties are, depends on the structure of the business. For companies, the board of directors must approve the MSS, while for partnerships and LLPs, the members need to approve the MSS. What is modern slavery?
Modern slavery is an umbrella term for all forms of slavery, servitude, forced or compulsory labour and human trafficking. The Modern Slavery Act 2015 combats modern slavery and consolidates previous offences relating to trafficking and slavery. For more information, read Modern slavery statements.

Do I need a Modern Slavery Statement?
An annual MSS must be published by any business that:
-
is a body corporate (such as a private limited company) or a partnership, wherever incorporated or formed
-
carries on a business (or part of a business) in the UK
-
supplies goods or services, and
-
has an annual turnover of at least £36 million
Where a business does not meet these criteria, it may publish a voluntary MSS to show how it handles modern slavery and human trafficking in its operations and supply chains. Businesses may wish to make a voluntary MSS if they:
-
are involved in lucrative transactions involving bidding for contracts against businesses that have such statements in place
-
operate in a higher-risk industry for modern slavery (eg fishing, construction, food, hospitality, manufacturing, agriculture, recruitment or retail)
-
are asked by a client business to provide a statement setting out their approach to tackling modern slavery

How do I determine the business’ risk environment?
To determine the risk environment of the business, you will need to conduct a situation-specific risk assessment. You will need to consider:

the products and/or services that are used, including the suppliers who provide them
-
any relevant internal and external sources (eg existing company policies, like a Whistleblowing policy or staff code of conduct)
-
any specific risks (eg country or sector risks)

What information should I include on supply chains?
You should explain the measures that the business has taken to ensure that there is no modern slavery or human trafficking within its supply chains. These include:

identifying the risks associated with the supply chain(s)

prioritising those risks
-
assessing their level of importance
-
ensuring that appropriate remedies are in place

Does my MSS need to be approved?
Your MSS will need to be approved by:
-
the board of directors, if the business is a company
-
the partnership members, if the business is an LLP or general partnership
Once approved, an MSS needs to be signed by either a:
-
director, if the business is a company
-
designated member, if the business is an LLP
-
general partner, if the business is a general partnership
-

Does the MSS need to be published?
If your business has a website, the MSS needs to be published on the website by placing a link in a visible place on the homepage or in a drop-down menu. The MSS should be published on each website if there is more than one relevant website.
If your business does not have a website a copy of the MSS needs to be provided to anyone who requests one in writing within 30 days.
Modern Slavery Statements can also be published online on the Government’s modern slavery statement registry. While this is currently not mandatory, businesses are encouraged to do so. In future, it is expected that all organisations required to produce an MSS need to submit their most recent statement to the registry.
